Success at the ICDR

Hanszen Laporte partner, Matthew S.C. Hansel, recently achieved a significant win in complex litigation before the International Centre for Dispute Resolution. Mr. Hansel’s client, an international oil and gas exploration and production company, was sued by two international state-sponsored oil companies to recover huge sums in interest related to significant tax liabilities that arose following the Claimants’ 10-figure purchase of one the client’s subsidiary companies. Mr. Hansel successfully argued to the ICDR Tribunal sitting in New York that the Claimants failed to perfect their demand for indemnification to his client until 2019—many years after the triggering tax liabilities—and that his client tendered payment of its indemnification obligation for the tax liabilities in 2019, many months before the date Claimants ultimately accepted payment. As a result, Mr. Hansel narrowed the time frame during which interest accrued against his client from nearly a decade to several months, saving his client in excess of $23,000,000.00 by reasonable estimates.
